Why This Matters

Two dangerous bills are moving through the Virginia General Assembly that would fundamentally threaten Second Amendment rights by targeting lawful firearm manufacturers, distributors, and dealers with costly and subjective lawsuits.
  • HB 21 (House Bill 21) has already passed the House of Delegates and is now in the Senate Committee for Courts of Justice.
  • SB 27 (Senate Bill 27), its companion, has already passed the Senate and is now in the House of Delegates.
These bills are nearly identical and represent a direct attack on the firearm industry and law-abiding gun owners.What These Bills Would DoHB 21 and SB 27 would:
  • Impose vague “reasonable conduct” standards on how firearm industry members manufacture, market, distribute, and sell perfectly legal products.
  • Allow the Attorney General, local government attorneys, or any private citizen claiming injury to sue firearm businesses for alleged violations.
  • Create a new “public nuisance” cause of action that could be used to hold manufacturers and dealers liable for criminal misuse of firearms by third parties — even when the business followed all laws.
This is a deliberate end-run around the federal Protection of Lawful Commerce in Arms Act (PLCAA), which Congress passed in 2005 specifically to prevent exactly this kind of lawsuit abuse against the firearm industry.Why These Bills Are Dangerous
  1. They invite abusive litigation designed to bankrupt manufacturers and dealers through endless legal costs, even if they win in court.
  2. They threaten the availability of firearms in Virginia. Dealers and distributors may stop doing business in the Commonwealth rather than face constant lawsuit risk, leading to fewer choices and higher prices for law-abiding citizens.
  3. They undermine Second Amendment rights by attacking the lawful commerce that makes exercising those rights possible.
  4. They set a precedent used in other states (like California and New York) to drive gun stores out of business and restrict access to common firearms and accessories.
These are not public safety measures — they are ideological attacks meant to achieve through the courts what anti-gun politicians cannot achieve through legislation.
